Anyone ever fought a "Fail to Yield" charge??

Time to face the music about my charge when I pulled out of the gas station and got hit. I got charged. Has anyone faced a similar charge and defended it??

Ravi,

My father had that happen to him a couple of years ago. He was pulling out of a gas station with a truck and trailer into one of those center lanes, and just as / after he got out, a lady in a rush decided to use the center lane as a passing lane. She split his trailer in half, and wrecked her car, luckily she was ok. Even though she admitted fault, the police officer charged my father on the spot because she had to follow procedures. I guess they always nail the person that is pulling out / yielding into traffic. She did tell him that if he fights it in court, they would most likely drop the charge and give him something less serious. He went to court with no representation and they advised him to plee guilty for a lesser charge (improper left turn or something similar). I don't think he had much of a chance to take the non-guilty approach and fight it.

Do you have a court date set-up? It is probably best to just go on your own instead of paying one of those ex-coppers etc. I think they always offer you a lesser charge anyways for this sort of thing. Maybe others know if it makes a difference paying someone to defend you.

I wish you luck in getting this dropped.

It's my lucky day. The charge was dropped--clean. Devon that is EXACTLY what happened to me.

I saw the ticket date September 22nd--TWO DAYS before the birth of my 3rd son. Not sure how I made it through that one!!

FYI--that night when it happened I was very nice to the Police Officer--I am pro-Police, they got a hard job and I give them credit for it. Anyways I admitted I made a dumb ass mistake and was just a good guy in general who didn't want to get killed by my insurance. He was a nice guy also and advised me to go to court (which in hindsight was very specific advice). When I went to court he remembered me and approached me with outstretched hand to shake-I again explained that I understood that there were costs associated with the accident (Police time/admin costs etc) and that it was not the fee but the CONVICTION/POINTS that concerned me. Long story short--he advised the Crown that he had "written the wrong ticket". Case dismissed.

Good for you! Shows not all cops are azzholes! When I was about 19 in Winnipeg I had an off duty detective get my charged dropped as well.
